Appellant, Johnny Luke, was convicted of capital murder on September 30, 1982, and was sentenced to death on October 29, 1982. His conviction and sentence were affirmed. Luke v. State, 444 So.2d 393 (Ala. Crim. App.), affd, 444 So.2d 400 (Ala. 1983), cert. denied, U.S., 104 S.Ct. 2374 (1984). Appellant filed a petition for writ of error coram nobis questioning the constitutionality of his conviction for the capital offense, and an evidentiary hearing was held on November 30, 1984. The petition was denied and this appeal followed.
